Byron York: In Trump-Russia probe, was it all about the Logan Act?

by |

The documents outlining Michael Flynn's guilty plea in the Trump-Russia investigation do not allege collusion or conspiracy between the Trump campaign and Russia to influence the 2016 election. They do, however, suggest that the Obama Justice Department was intensely interested in Flynn's discussions with Russian ambassador Sergey Kislyak about policy issues — sanctions against Russia, a United Nations resolution on Israel — during the presidential transition, when Barack Obama was still in the White House and Donald Trump was preparing to take office.

At the time, top Justice officials suspected Flynn of violating the Logan Act, the 218-year-old law under which no one has ever been prosecuted, that prohibits private citizens from acting on behalf of the United States in disputes with foreign governments. Starting in the summer of 2016 and intensifying in the transition period, the Logan Act, while mostly unknown to the general public, became a hot topic of conversation among some Democrats. A number of lawmakers, former officials, and commentators called on the Obama administration to investigate the Trump team for a possible Logan Act violations — and to do it while Democrats still controlled the executive branch......To Read More.....

My Take - Byzantine corruption is the best word to describe this.  An administration that violated more laws than any administration since the Roosevelt administration was all of a sudden concerned with the Logan Act and President Elect Trump and his new team in it's final days.

Even if what occurred may have been a technical violation of the law it certainly wasn't a violation of the spirit of the law.  However...... in 1984 we know Ted Kennedy clearly violated the Logan Act when he asked the Soviet Union - at that time an absolute enemy of the United States - "to intervene on behalf of the Democratic party in the 1984 elections."

"Kennedy’s communist communique was so secret that it was not discovered until 1991, eight years after Kennedy had initiated his Soviet gambit", which was to undermine Reagan in his nuclear arms agreement with the Soviets.  That was absolute treason!  "You can read the full KGB memo detailing Kennedy’s secret letter and request for electoral intervention here."

I might add - all those trips Jimmy Carter made around the world after he left office in his idiotic private negotiations with world leaders - is not just a technical violation of the Logan Act - it's an absolute violation.  This isn't just a matter of - well they did it too - argument.  It seems to me this is clearly a matter of selective prosecution for political gain.

Trump needs to start firing people who aren't prepared to win.

Here's another article that clearly shows this is a partisan effort, with the author making the point  - this is what would have been standard practice under President Hillary Clinton.
